The Project Crimson Charitable Trust – Terms & Conditions of Trade

Thank you for your order. We ask that you take the time to read our terms & conditions of trade.                        
1.       Definitions: “Seller” refers to Project Crimson.
2.       “Buyer” refers to any person acting on behalf of and with the authority of the Buyer.
3.       Any instructions received by the Seller from the Buyer for the supply of goods or acceptance of goods by the Buyer shall constitute acceptance of the terms and conditions contained herein.
4.       None of the Seller’s agents or representatives are authorised to make any representations, statements, conditions or agreements not expressed by the manager of the Seller in writing nor is the Seller bound by any such unauthorised statements.
5.       The Price of Goods/Services shall be the Sellers current price at the date of sale.
6.       The Price shall be increased by the amount of any shipping costs.
7.       Pre-payment for the first delivery of goods must be received by the Seller before the goods are delivered.
8.       Goods will be delivered to the Buyer’s nominated delivery address by the Seller’s chosen carrier.
9.       The Buyer hereby disclaims any right to cancel the contract or to sue for damages or to claim restitution arising out of any misrepresentation made to the Buyer by the Seller or the Sellers agent or representatives and the Buyer acknowledges that their order is made relying solely upon the Buyer’s own skill and judgement.
10.    Claims will not be accepted by the Seller when the Goods have been altered, processed or utilised.
11.    The risk for the Goods passes to the Buyer on delivery.
12.    If the Buyer does not comply with the Sellers terms of payment then the Seller reserves the right to on sell any outstanding Goods ordered by the Buyer.
13.    The Seller may cancel this contract at any time by giving written notice. The Seller shall not be liable for any loss or damage whatsoever arising from such cancellation.
14.    Cancellation of any order must be submitted in writing. The Seller has no obligation to accept cancellation of any part of the order once the order has been submitted to the Buyer. Decisions regarding the acceptance of cancellation of any part of the order are at the discretion of the Seller.
15.    The Buyer may not use the Seller’s logos nor any photograph or image of the Goods supplied by the Seller without written permission of the Seller.
16.    The Seller can at any time review these terms and conditions. If, following any such review, there is to be any change in such terms and conditions, that change will take effect from the date on which the Seller notifies the Buyer of such change.
